Federal Court Orders Release of Abrego Garcia from ICE Detention

A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without lawful basis.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.

The situation originates in a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his return to the United States to answer alien smuggling charges, he was held in federal detention.

In her order, the judge noted that the government lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The legal challenge center on disputed assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.

He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing criminal case in Tennessee.

Conditions of Freedom

The judge, who was overseeing his petition to removal in a federal court, determined that he must now comply with the conditions of his bond from custody in Tennessee. This order shifts his monitoring to the jurisdiction handling his criminal case.
